Trip Wizard Terms of Use

1. Introduction and Acceptance
1.1 Agreement to Terms
By accessing or using Trip Wizard (hereinafter referred to as "the App," "Trip Wizard," "we," "us," or "our"), you agree to be bound by these Terms of Use and App Rules (the "Terms"). These Terms constitute a legally binding agreement between you and Trip Wizard. If you do not agree with any part of these Terms, you must not access or use our services.
1.2 Changes to Terms
Trip Wizard reserves the right to modify these Terms at any time. We will notify users of any material changes through the App or via email. Your continued use of Trip Wizard following such modifications constitutes your acceptance of the updated Terms.
2. User Eligibility and Account Creation
2.1 Eligibility Requirements
To use Trip Wizard, you must be at least 18 years old and have the legal capacity to enter into a binding contract. You must not be prohibited from using our services under applicable laws. During registration and throughout your use of the platform, you are required to provide accurate and truthful information.
2.2 Account Creation and Maintenance
Each individual is permitted to maintain only one active account on the platform. Your account must be registered with accurate, current, and complete information. You bear full responsibility for maintaining the confidentiality of your account credentials and for all activities that occur under your account. This includes keeping your account information up to date and implementing reasonable security measures, such as strong passwords and proper logout procedures.
2.3 Account Verification
Trip Wizard implements various user verification processes to ensure the authenticity of accounts. This verification process may include email confirmation, phone number verification, and identity document verification. For Trip Planners, additional verification of travel experience may be required to ensure service quality.
3. User Roles and Responsibilities
3.1 Trip Planners
Trip Planners must possess genuine travel experience in their offered destinations. For each destination expertise claimed, Trip Planners must specify their last visit date to provide transparency to travelers. They are required to respond to planning requests and maintain professional communication throughout the planning process. All travel advice and recommendations must be honest and provided to the best of the Trip Planner's knowledge based on their experiences. Trip Planners are expected to deliver agreed-upon services within specified timeframes.
3.2 Travelers
Travelers must provide clear and accurate information regarding their trip requirements and preferences. This includes desired destinations, travel dates, budget constraints, and any specific needs or preferences. Travelers are expected to communicate professionally with Trip Planners and provide timely responses during the planning process. All payments must be processed through the platform's designated payment system. If travelers choose to provide feedback, it must be honest and fair.
4. Service Standards and Quality Control
4.1 Service Quality Requirements
Trip Planners' ratings and reviews are publicly displayed to help travelers make informed decisions. Professional communication standards include timely responses, clear explanations, and courteous interaction. Trip Planners must maintain accurate information about their travel experiences and destination knowledge on their profiles.
4.2 Rating System
The platform employs a comprehensive rating system evaluating multiple aspects of service delivery. Travelers rate their experience based on overall satisfaction, communication quality, itinerary thoroughness, value for money, and demonstrated local expertise. These ratings contribute to the Trip Planner's overall standing on the platform and influence their visibility to potential clients.
4.3 Quality Monitoring
Trip Wizard actively monitors service quality through continuous assessment of user ratings, completion rates, and response times. The platform conducts regular reviews of content quality and customer satisfaction. User reports are investigated thoroughly, and appropriate actions are taken to maintain service standards.
5. Prohibited Conduct
5.1 Platform Integrity Violations
Users are strictly prohibited from creating multiple accounts or providing false information. Any attempt to circumvent platform fees or manipulate the rating system will result in immediate action. The use of automated systems or bots is forbidden, as is the creation of fake bookings or transactions.
5.2 Communication Standards
While all primary communication should remain within the platform, users may choose to share personal contact information at their own discretion. Trip Wizard bears no responsibility for any consequences arising from personal information exchanges between users outside the platform. The platform must not be used for dating or non-travel purposes. Any form of harassment, discriminatory behavior, or threatening language will result in immediate suspension. Users may not distribute spam or unsolicited promotional content.
5.3 Commercial Violations
The promotion of external business services is strictly prohibited. Users may not engage in unauthorized advertising or attempt to sell or transfer their accounts. The collection of user information for commercial purposes outside the scope of travel planning is forbidden.
6. Payment Terms and Financial Policies
6.1 Payment Processing
All financial transactions must be processed through Trip Wizard's designated payment system. The platform clearly displays all fees and commissions prior to transaction completion. Various payment methods are supported, with currency conversion rates determined by Trip Wizard. Users acknowledge that payment processing fees may apply to transactions.
6.2 Fee Structure
The platform implements a transparent fee structure that includes platform commissions, service fees, and payment processing charges. Currency conversion fees may apply to international transactions. Cancellation fees are assessed according to the timing and circumstances of the cancellation. Refund processing fees may be deducted from refunded amounts.
6.3 Refund Eligibility
Users are eligible for a complete refund when the itinerary contains verifiably plagiarized content, fails to include specifically requested major elements, or recommends activities that violate local laws or safety guidelines.
Refunds will not be provided in cases of personal preference disagreements, changes in travel plans, external factors such as weather or currency fluctuations, or attempts to circumvent the platform payment system.
6.4 Refund Process
All refund requests must be submitted through the platform's reporting system within 48 hours of itinerary receipt. Users must provide supporting evidence where applicable to substantiate their claims.
The platform will complete an initial review within 24 hours of submission. Trip Planners will be given an opportunity to respond to claims, and a final decision will be communicated within 48 hours of the initial submission.
Approved refunds will be processed within 5 business days and returned to the original payment method. Platform fees will be included in full refunds when applicable.
7. Intellectual Property Rights
7.1 Platform Content
Trip Wizard retains exclusive rights to all platform-related intellectual property, including the interface design, logos, trademarks, and marketing materials. System-generated content, algorithmic recommendations, and platform features are protected by applicable intellectual property laws.
7.2 User-Generated Content
While users retain rights to their original content, they grant Trip Wizard a non-exclusive license to display, distribute, and modify content for platform purposes. This includes the right to use content for marketing and promotional activities, subject to our privacy policy and user agreements.
7.3 Content Usage Rules
All users must respect copyright laws and provide proper attribution when required. The sharing of platform content is restricted to personal, non-commercial use unless explicitly authorized by Trip Wizard. Content modification must comply with platform guidelines and respect original creators' rights.
8. Privacy and Data Protection
8.1 Data Collection and Use
Our data collection practices align with our Privacy Policy, last updated September 26, 2024. We collect account information, usage data, device information, and communication content necessary for platform operation. Location data is collected only with explicit user permission. All data collection adheres to applicable privacy laws and regulations.
8.2 Data Protection Measures
We implement comprehensive security measures to protect user data, including encryption protocols and secure server infrastructure. Regular security audits are conducted to maintain data protection standards. Access control systems limit data exposure, and incident response protocols ensure swift action in case of security events.
8.3 User Privacy Rights
Users maintain comprehensive rights regarding their personal data, including access to collected information and the ability to request corrections. Account deletion options are available, along with data export capabilities. Users may opt out of marketing communications while maintaining essential service notifications.
9. Reporting and Enforcement
9.1 Reporting System
The platform provides multiple channels for reporting violations, including an in-app reporting function and dedicated support email. Emergency reporting options are available for serious violations. All reports are treated confidentially and reviewed promptly by our support team.
9.2 Investigation Process
Each report undergoes thorough review within 48 hours of submission. Our investigation process includes evidence collection, user interviews when necessary, and comprehensive documentation review. External experts may be consulted for complex cases, and all parties receive communication regarding investigation outcomes.
9.3 Enforcement Actions
The platform employs a progressive discipline system beginning with warnings and escalating through temporary suspensions to account termination. Severe violations may result in immediate account suspension or termination. All enforcement actions are documented and communicated to affected users.
10. Dispute Resolution
10.1 Internal Resolution Process
Disputes are initially addressed through direct communication between parties, with platform mediation available when needed. The support team may intervene to facilitate resolution, and Trip Wizard maintains authority for final decisions in unresolved disputes.
10.2 Appeals Process
Users may appeal enforcement actions within 14 days of implementation. Appeals must include supporting evidence and clear justification for reconsideration. Each incident permits one appeal, and appeals are reviewed by senior support staff not involved in the original decision.
10.3 Binding Decisions
Platform decisions following the appeals process are final and binding. Users retain legal rights as provided by applicable law, and arbitration provisions may apply in certain jurisdictions. The platform specifies governing jurisdiction for legal proceedings.
11. Limitation of Liability
11.1 Service Provision
Trip Wizard provides its platform on an "as is" basis without specific guarantees of outcomes. While we strive for service quality, we cannot guarantee specific travel results or user experiences. The platform serves as a facilitator of travel planning services rather than a direct service provider.
11.2 Liability Limitations
The platform's liability is limited to direct damages with specific monetary caps as permitted by law. Indirect or consequential damages are excluded from liability coverage. Force majeure events absolve the platform of performance obligations under such circumstances.
